1. Acceptance of these terms
These Terms of Service (“Terms”) govern your access to and use of the C.A.R.S. Automotive website at carssunnyside.com, our online service-request and appointment tools, and the calls, text messages, and emails we send in connection with them (together, the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
Repair and maintenance work on your vehicle is governed by the written estimate or invoice you approve and by our Parts & Labor Warranty. These Terms do not change those documents.
2. About C.A.R.S. Automotive
C.A.R.S. Automotive LLC (“C.A.R.S. Automotive,” “we,” “us,” or “our”) is a full-service auto repair shop at 405 Scoon Rd, Sunnyside, Washington 98944. The website describes our services and lets you request service, schedule an appointment, and contact the shop.
3. Service requests and appointments
- An appointment requested through the website is placed on our schedule when you choose a time. We may contact you to confirm details, adjust the time, or ask about your vehicle, and we may need to reschedule if the shop cannot accommodate the request.
- Prices shown on the website are starting prices for common jobs and are not a quote for your vehicle. The cost of work is set by the written estimate you approve before work begins. Diagnostic fees are described on our services page.
- Please give us accurate information about yourself and your vehicle, and let us know as early as you can if you need to cancel or move an appointment.
- Under Washington’s Automotive Repair Act (Chapter 46.71 RCW) you have the right to a written estimate before repairs that will cost more than $100, the right to authorize any work that would exceed that estimate, and the right to ask that replaced parts be shown or returned to you. We follow those rules on every job.
- Vehicles left at the shop, work authorizations, parts, payment, and storage are subject to the terms on your estimate and invoice and to Washington law.
4. Acceptable use of the website
You agree not to:
- Use the Services in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to the Services or to any related system, network, or account.
- Interfere with or disrupt the integrity or performance of the Services, including by submitting automated or bulk requests.
- Use any automated means to scrape, harvest, or copy content or data from the Services without our written permission.
- Submit false, misleading, or fraudulent information, including a phone number you do not own or are not authorized to use.
5. Text messaging terms
Our forms offer two separate consents. The non-marketing consent is required to submit a request, because we need to be able to reach you about it. The marketing consent is separate, optional, never checked in advance, and not a condition of purchase. Each is recorded with the date and time, and each can be withdrawn at any time.
Non-marketing messages
By providing your mobile phone number and checking the non-marketing consent box, you consent to receive calls and text messages from C.A.R.S. Automotive about your service request, scheduling, and vehicle updates at the number provided, such as appointment confirmations and reminders, rescheduling and cancellation notices, questions about your vehicle, updates about work in progress, and replies to messages you send us.
Marketing messages
By checking the separate marketing consent box, you consent to receive recurring text messages about special offers, discounts, and service updates from C.A.R.S. Automotive at the number provided. Consent to marketing messages is not a condition of purchase or of any service.
Frequency, cost, and carriers
Message frequency varies. Message and data rates may apply. The program is available in the United States and supports major U.S. wireless carriers. C.A.R.S. Automotive and the carriers are not liable for delayed or undelivered messages.
Opt-out and help
Reply STOP to any message to opt out. After we receive STOP, we will send one confirmation message and stop all automated text messages to that number, marketing and non-marketing alike. To opt back in, check the consent box again on one of our forms or ask us in person. Reply HELP to any message for assistance, or call 509-839-1772.
Privacy
Our handling of your mobile information is described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
6. Intellectual property
All content on the Services, including text, graphics, photographs, software, designs, and the C.A.R.S. Automotive name and logo, is owned by or licensed to C.A.R.S. Automotive and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent, except for viewing and printing pages for your own personal, non-commercial use.
7. Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. INFORMATION ON THE WEBSITE, INCLUDING PRICES, HOURS, AND SERVICE DESCRIPTIONS, MAY CHANGE WITHOUT NOTICE. THIS SECTION APPLIES TO THE WEBSITE AND MESSAGING SERVICES ONLY; THE WARRANTY ON REPAIR WORK IS SET OUT IN OUR PARTS & LABOR WARRANTY AND ON YOUR INVOICE.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, C.A.R.S. AUTOMOTIVE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE WEBSITE OR MESSAGING SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). THIS LIMITATION DOES NOT APPLY TO CLAIMS ABOUT REPAIR WORK, WHICH ARE GOVERNED BY YOUR INVOICE, OUR WARRANTY, AND APPLICABLE LAW, AND DOES NOT LIMIT ANY LIABILITY THAT CANNOT BE LIMITED BY LAW.
9. Indemnification
You agree to defend, indemnify, and hold C.A.R.S. Automotive and its owners, employees, and agents harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Services.
10. Governing law and dispute resolution
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws principles. Subject to Section 11, any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Yakima County, Washington, and you consent to the personal jurisdiction of those courts.
11. Arbitration and class action waiver
Please read this section carefully. It affects how legal disputes between you and C.A.R.S. Automotive about the Services are resolved.
Agreement to arbitrate
You and C.A.R.S. Automotive agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a “Dispute”) will be resolved by binding individual arbitration, except that either party may bring an individual action in small-claims court, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or to address unauthorized access to the Services.
Arbitration procedures
The arbitration will be administered by JAMS under its Streamlined Arbitration Rules, or by another arbitration provider the parties agree on. It will be conducted in English in Yakima County, Washington, unless you and C.A.R.S. Automotive agree otherwise or the arbitrator decides an in-person hearing is unnecessary. The arbitrator’s award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver
You and C.A.R.S. Automotive agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of representative or class proceeding. If a court decides that this waiver is unenforceable as to a particular claim, that claim alone will be severed and may be brought in court, and all other claims will proceed in arbitration.
Opt-out right
You may opt out of this arbitration agreement by sending written notice to C.A.R.S. Automotive LLC, 405 Scoon Rd, Sunnyside, WA 98944, within 30 days of first agreeing to these Terms. Your notice must include your name, address, and a clear statement that you want to opt out of arbitration. Opting out does not affect any other provision of these Terms.
Time limit
To the maximum extent permitted by law, any claim arising out of or related to the Services or these Terms must be filed within one (1) year after it arose, or it will be permanently barred.
12. Miscellaneous
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and C.A.R.S. Automotive regarding the Services, and supersede any prior understandings about them. Your estimate, invoice, and our warranty govern repair work.
- Severability. If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force.
- No waiver. Our failure to enforce a provision is not a waiver of that provision or of our right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, sale of assets, or by operation of law.
- Force majeure. Neither party is liable for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, government action, labor disputes, network or power failures, or third-party service outages.
- No third-party beneficiaries. These Terms create no rights for anyone other than you and C.A.R.S. Automotive.
- Notices. Notices to us should be sent to C.A.R.S. Automotive LLC, 405 Scoon Rd, Sunnyside, WA 98944. Notices to you may be sent to the phone number or email address you provide.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Services after changes are posted means you accept the changes.
